Notary Retainer for Senior Living, Home Health, Hospice & Healthcare

Residents and patients need powers of attorney, affidavits, and other documents notarized all the time — and families ask your staff to find someone. In Illinois, your facility’s own leadership often isn’t allowed to help: the law bars owners, operators, directors, and executive officers of a resident’s facility from notarizing or witnessing that resident’s property power of attorney. A notary retainer gives you an independent, commissioned notary on a standing visit schedule and on call for urgent bedside signings.

  • Built for: senior-living communities, nursing homes, home-health and hospice agencies, and hospital or clinic records departments
  • Coverage: on-site in Naperville & Chicagoland, plus nationwide Remote Online Notarization
  • Billing: one monthly invoice, plans starting at $349/mo

Why a notary retainer makes sense for you

  • An Illinois power of attorney for property must be both witnessed and notarized, and the facility’s owner, operator, directors, or executive officers may not serve as witness or notary for a resident (755 ILCS 45/3-3.6).
  • A standing “notary day” lets your social worker or front desk book families into one slot instead of arranging a notary for each request.
  • Urgent bedside signings — when a resident’s condition changes — get priority response under the retainer.
  • Home-health and hospice teams can send us to patients’ homes across the western suburbs on one monthly invoice.
  • Families who live out of state can sign their part through Remote Online Notarization.

Documents we notarize for you

  • Powers of attorney for property (and health care, if the family wants it notarized)
  • Affidavits and sworn statements for benefits, insurance, or banking
  • Wills, trusts, and related estate documents prepared by the family’s attorney
  • Vehicle title transfers and bills of sale
  • Records custodian affidavits for hospitals and clinics, when the requester requires notarization

Good to know

  • The signer must be alert, understand what they are signing, and sign willingly. If a resident cannot, the notary must decline — we will talk timing through with your staff.
  • An Illinois health care power of attorney needs one adult witness but does not need a notary; a property power of attorney needs both. Families should arrange a qualified witness — the witness cannot be the resident’s physician, a relative, the agent, or the facility’s owner or operator.
  • Records departments: Illinois court filings generally accept a signed certification in place of a notarized affidavit (735 ILCS 5/1-109). Notarization matters most for out-of-state courts, federal agencies, and insurers that require it.

Frequently asked questions

Why can’t our administrator just notarize for residents?
Illinois law bars the owner or operator of a resident’s health-care facility — and its directors and executive officers — from notarizing or witnessing that resident’s property power of attorney. Many facilities also have policies against staff notarizing for residents. An independent notary avoids both problems.

Who pays — the facility or the family?
The retainer is billed to the facility as one monthly invoice. Many communities treat it as a resident amenity; call us to talk through what fits your policies.

How is a retainer priced if Illinois caps the notary fee at $5?
The $5 cap applies to each notarial act. A retainer covers scheduled visits, travel, priority response, and remote-signing technology. Plans start at a flat monthly rate and are matched to your volume — call or text 847-436-5222 for a quote.

Can you also notarize remotely?
Yes. We are a commissioned Illinois Remote Online Notary, so any plan can add audio-video notarization for signers anywhere in the U.S. — useful when an owner, family member, or subcontractor is out of town. Confirm first that whoever receives the document accepts electronic notarization.

Do you prepare or fill in the documents?
No. A notary cannot draft documents, fill in blanks, or give legal advice. Have documents complete but unsigned; we verify identity, watch each signer sign, and complete the notarial certificate.
